BIA & Circuit Court Appeals
At Johnson & Nicholson, PLLC, we assist clients with various types of immigration appeals. Denials of cases before Immigration Judges and certain petitions can be appealed. The first Court to hear an appeal is the Board of Immigration Appeals or BIA. This tribunal is located in Falls Church, Virginia. Our firm can assist with the preparation and filing of a Notice of Appeal and written legal arguments also known as a brief. We have prepared many briefs to various courts for clients.
If a case is lost at the BIA, a litigant can appeal to the United States Court of Appeals in the circuit the case originated. There are thirteen different federal Courts of Appeals. Our office will identify the applicable circuit court and discuss the appeal with you. At this level, careful consideration must be given to the issues that will be raised on appeal.
Lastly, if a case is lost at the United States Court of Appeals, a litigant can file a request to have the case heard before the United States Supreme Court.
